History of Legal Highs

Legal highs began to become really popular with the rapid growth of the internet.  Before that, legal highs were available if you knew people who personally grew a few herbs that were used to produce a minor feeling of euphoria or relaxation.  The science of legal highs has progressed a lot since then and produced two families of legal highs: ethno-botanicals, which are natural plants producing these narcotic effects, and chemicals which research scientists played around with to create products that give you a feeling of euphoria, increased energy or deep relaxation.

A lot of the drugs that were available legally in those early days have now been banned due to concerns about their side-effects.  In their place came a couple of main legal highs.  Largely, these were sold as mysterious powders in unmarked bags.  The control of what was in the powders was limited.

Soon, though, that changed when legal highs began to be sold in capsules, stored in packets, through reputable stores.  Caffeine tablets went on open sale on the high street.

In the first years of the 21st century, bongs – or water pipes as they are more formally called – have become the method of choice of ingesting legal highs for many people.  Legal highs consisting of plants and organic material are increasing in popularity among a wide range of people, not just clubbers and students.  These latest legal highs are inhaled through a bong or vaporizer and provide a sense of euphoria or extreme relaxation that can be achieved in no other legal way.

Manufacturing the Drug Threat

N.B. This blog comes with a policy nerd warning! Those who have followed the drugs debate will be only too aware of the way that politicians play on the fears of their citizens in order to maintain the war on drugs, despite the fact that it is their citizens who bear the brunt of its counterproductive effect. The International Relations theory of securitisation describes, better than any framework I’ve seen, how the threat-based process works. Moving to a non-securitised approach is essential to ending the war on drugs.

Securitisation is described as “the move that takes politics beyond the established rules of the game and frames the issue either as a special kind of politics or as above politics” (Buzan et al. 1998: 23). By declaring something a security issue, the speaker entitles himself to enforce and legitimise unusual and extreme measures to fight this threat. Referenced from here.

Rita Taureck of the University of Birmingham describes securitisation:

“The main argument of securitisation theory is that security is a speech act, that alone by uttering ‘security’ something is being done. “It is by labelling something a security issue that it becomes one.”(Wæver 2004a,) A securitising actor, by stating that a particular referent object is threatened in its existence, claims a right to extraordinary measures to ensure the referent objects survival. The issue is then moved out of the sphere of normal politics into the realm of emergency politics, where it can be dealt with swiftly and without the normal (democratic) rules and regulations of policy making. For the content of security this means that it has no longer any given meaning but that it can be anything a securitising actor says it is. Security - understood in this way - is a social construction, with the meaning of security dependent on what is done with it.”

Legal highs are chemical or herbal compounds which produce euphoria or deep relaxation, and are very popular in clubs.  These legal high are easily available in shops and on the internet.  They come in pill form or in a form which is smoked through bongs or water pipes.  They are said to offer a safer, less contaminated alternative to illegal drugs and, of course, you cannot be arrested and convicted for possessing them and using them, although different legal highs are being reclassified all the time.

Many people who have tried the legal highs are surprised by the potency of some of the most popular brands.  These stimulants are on sale from various so-called ‘headshops’ and online outlets.  These outlets claim to produce a range of pep pills and smoking mixes for bongs that can produce many different and subtle variations when it comes to effect.  These range from a mellow, giggly feeling to a full-on ‘trip’ as one might expect from illegal drugs, but without the nasty side-effects or legal connotations.

Grey Market

Legal highs are a range of, up to now, relatively unknown stimulant drugs.  They are appearing on what has been termed the ‘grey market’, which is an area which is not illegal but is on the fringe of being so.  More legal highs are outlawed regularly as more about them becomes known.

Smoking a Bong

Smoking bongs – or water pipes – was very popular in past centuries, and it has again risen to prominence in Western societies in the last few years as a way to enjoy legal highs.  However, it may take you a few times using a bong to actually get the hang of it.  This is because you may not be inhaling the legal high substance properly and holding it in your lungs long enough to experience the desired sensation. 

What is a Bong?

A bong is a particular type of glass, ceramic or acrylic device used for smoking an herbal mixture.  Unlike other pipes, a bong is usually cooled down with water, which is what makes enjoying a legal high using a bong a much smoother, more pleasant smoke.

How Does a Bong Work?

All bongs work in a similar way.  The stem of a bong is shaped like a bowl with a tube attached to it.  The cylindrical end of the stem is connected to the bong chamber.  Water goes inside the bong chamber, through which you smoke the legal high, sealing your lips around the top of the chamber so that smoke does not escape.

You put water in the chamber of the bong and the smoke from your legal high rises up through this water.  You smoke it by sealing your mouth around the top of the chamber and inhaling.  Remember not to pack the bong bowl with too much of the legal high substance, so that you have room to inhale air through the mixture.

The following press release has been issued by Law Enforcement Against Prohibition (LEAP) . Whilst some way from a shift in policy it is at least a significant shift in tone, especially given the US Drug Tsar's insistence that 'legalization is not in the president's vocabulary nor is it in mine'.

Well, here he is talking about it, and certainly not laughing it off like the last time he was asked. He specifically says he doesnt support legalisation, but certainly seems to be edging towards some form of decriminalisation of use. Progress then, albeit small steps. And as LEAP make clear - its important for actions to match words.

Obama Says Legalizing Marijuana and Other Drugs a "Legitimate Topic for Debate"
President Says We Need to Shift to Public Health Focus, But His Budgets Haven't Done That

WASHINGTON, DC -- Today, in response to a video question from a former deputy sheriff about whether it is time to discuss legalizing and regulating drugs in light of the failure of the "war on drugs," President Barack Obama said that it is "an entirely legitimate topic for debate" but that he is not in favor of legalization.

The President then went on to say that he sees drug abuse as a public health issue and that a shifting of resources is required, away from the traditional approach of incarcerating nonviolent drug offenders.

"The president talks a good game about shifting resources and having a balanced, public health-oriented approach, but it doesn't square with the budgets he's submitted to Congress," said Neill Franklin, a retired Baltimore narcotics cop and executive director of Law Enforcement Against Prohibition (LEAP), a group of cops, judges and prosecutors who support legalizing and regulating drugs. "The Obama administration has maintained the Bush-era two-to-one budget ratio in favor of prisons and prosecution over treatment and prevention. It doesn't add up. Still, it's historic that the president of the United States is finally saying that legalizing and regulating drugs is a topic worthy of discussion. But since the president remains opposed to legalization, it's clear that the people are going to have to lead the way. Police officers and innocent civilians are dying every single day in this drug war; it's not a back-burner issue."

The president's comments today, part of a forum organized by YouTube where people could submit and vote on questions, came in response to a question from MacKenzie Allen, a LEAP member and a retired deputy sheriff who did policing in Los Angeles, CA and King County (Seattle), WA. Allen's question got the most votes in the contest, garnering twice as many as the second most-popular question.
